The Bankruptcy Process

Why You Need a Bankruptcy Attorney

Understanding the process of filing for bankruptcy is something that many people grasp only after filing their bankruptcy petition with the local bankruptcy court, though it is something that should be fully understood before the petition has even been sought. If you are struggling with debt and you need legal assistance to guide you through the bankruptcy process, do not hesitate another moment longer before speaking with me, bankruptcy lawyer David Cahn. At my law firm, I work with individuals, families, and businesses in pursuing financial freedom. I aim to help you understand more about the bankruptcy process before you file your petition to ensure the greatest chance of success.

The first step in the bankruptcy process should always be to hire a bankruptcy lawyer. Even if you are still wondering whether bankruptcy is right for you, an attorney will be able to address your concerns. My law firm will be able to review your case during the first step of the bankruptcy process to help you choose if bankruptcy is the right option, or if an alternative to bankruptcy should be sought. If bankruptcy appears to be the right option, I will guide you through the means test to determine if Chapter 7 or Chapter 13 is the best option for you. After this decision has been made, I will work with you to gather all necessary information to file your petition with the court.

The bankruptcy court will require information such as the schedules of assets and liabilities, the current income of the debtor, current expenditures, a statement of financial affairs, and a schedule of executor contracts as well as unexpired leases. I will ensure that all of your documents are in order to avoid a denial during this step in the bankruptcy process.

Once this information has been submitted and processed, you will need to provide a filing fee and a miscellaneous fee, which varies depending on the chapter of bankruptcy you file for under the U.S. Bankruptcy Code. This filing fee may be eligible to be paid in installments should the debtor show financial hardship. Most consumer bankruptcy filings will essentially put a stop to lawsuits or collection actions that are against the debtor, so a foreclosure proceeding may be halted at this time. Additionally, the bankruptcy process will ensure that all creditors cease their communication and collection efforts for the debtor.
